Flying Under the Influence in California
When pilots are arrested, there’s more at stake than just criminal charges
Is it possible for a pilot to be charged with a DUI while flying? Yes. According to Federal Law, no person may perform the duties of a crew member or pilot an aircraft:
- While under the influence of alcohol;
- After consuming any alcoholic beverage within 8 hours of flying;
- After using any drug that affects the person's abilities for safety; or
- Having a blood-alcohol concentration (BAC) of 0.04 or greater.
The federal penalties for flying under the influence can be quite severe, with prison sentences up to 15 years and suspension or revocation of a pilot’s license or FAA certificate.
If a pilot is found guilty of Flying Under the Influence (FUI) in California, not only do they have possible federal issues to overcome but potentially state penalties as well. For example, under California Law, It is illegal for any person to:
