These tests function as preliminary identification tools only. The results are considered presumptive because they suggest the possible presence of illegal substances but cannot provide conclusive evidence. Specifically, the tests were never designed or intended to confirm the presence of drugs. Laboratory confirmation through gas chromatography and mass spectrometry remains necessary to verify field test results.

Approximately 773,000 of the more than 1.5 million drug arrests conducted in the United States each year involve the use of color-based presumptive tests. Officers rely on these screenings to establish probable cause for arrests and search warrants, enabling them to proceed with legal actions before laboratory confirmation becomes available.

The $2 Roadside Testing Kits

The physical kits consist of small plastic pouches holding vials of liquid chemical reagents. Officers pay roughly $2 per test. The pouches contain pre-filled, hermetically sealed glass ampoules held together by a plastic harness, along with a drug loading device. These portable kits allow officers to perform tests in any location without specialized equipment.

The low cost and simplicity make these kits attractive to law enforcement agencies. Officers open the pouch, use the loading device to place a small amount of the suspected substance inside, then break the glass ampoules from left to right. The entire process takes a few minutes from sample preparation to color observation.

Multiple companies manufacture these test kits, with at least nine companies selling tests to identify cocaine, heroin, marijuana, methamphetamine, LSD, MDMA, and more than two dozen other drugs. The NIK Test system represents one widely used brand, offering different reagent combinations for various drug classes.

Color-Based Chemical Reactions

The testing mechanism relies on chemical reagents that change color when exposed to specific compounds. Officers break the sealed ampoules, agitate the solution in the pouch, and watch for color changes. They then compare the resulting colors to charts printed on each pouch to interpret the results.

Different reagents produce distinct color reactions. The Marquis reagent turns purple in the presence of heroin and brown with amphetamines. For methamphetamine testing, officers typically use a two-step process: NIK Test A turns orange then brown, followed by NIK Test U which turns blue for a presumptive positive result.

The interpretation of color changes remains subjective. Colors must be read by the naked eye, and the accuracy of interpretation can vary with the experience of the analyst and the type or lack of lighting available when the test is performed. Officers receive basic training on how to use the kits, but the visual assessment of color changes introduces variability into the process.

The reagents react to functional groups of atoms rather than specific drug molecules. When these functional groups are present, a chemical reaction occurs that produces a color as its product. This fundamental limitation means the tests screen for compound categories rather than identifying specific substances.

Why Field Tests Produce False Positives

Non-Specific Chemical Reactions

The fundamental flaw in presumptive field tests stems from their chemical design. These tests react to functional groups rather than specific drug molecules. Functional groups are small clusters of atoms within larger molecules that determine chemical properties. However, these groups exist in numerous legal and illegal substances alike.

The Duquenois-Levine reagent demonstrates this limitation. Used for decades as the standard marijuana field test, it reacts with resorcinol, a functional group present in THC but not exclusive to it. Studies identified multiple benign substances yielding false positives, including cypress, patchouli, and eucalyptus. Lavender, oregano, and spearmint produced inconclusive results.

The Scott test for cocaine illustrates similar problems. While it distinguishes cocaine from other alkaloids, it fails to differentiate cocaine from other drugs. This non-specificity means the tests cannot positively identify a substance. They merely indicate that certain chemical groups may be present.

The color produced during testing varies based on drug concentration, form, and contaminants. Cross-reactivity with legal substances remains a persistent issue. Over-the-counter medications and herbal supplements commonly trigger false positives due to similar chemical structures.

Environmental Factors Affecting Accuracy

Testing conditions significantly impact results. Extreme cold or heat alter chemical reactions. Poor lighting makes color interpretation difficult, particularly problematic for tests conducted at night on roadside stops. Officers frequently administer these tests in conditions far from ideal for discerning subtle color changes.

Overdevelopment represents another critical issue. Officers who allow tests to develop too long will likely obtain false positives, as chemicals develop darker purple colors the longer they remain in contact. Exposure to air or extreme temperatures can cause false positives independent of the substance tested.

Operator error compounds environmental problems. Breaking ampules in the wrong sequence produces inaccurate results. The field conditions under which officers work make consistent, accurate testing nearly impossible.

Common Substances Triggering False Results

Tylenol PM tests positive for cocaine, while Hershey's chocolate triggers marijuana positives. Mucinex produces false positives for heroin and morphine. Soap can yield positive results for GHB. Household cleaners turn the chemical blue, the same color indicating illegal substances.

Poppy seeds contain small amounts of codeine and morphine. One poppy seed muffin or two poppy seed bagels produce morphine levels high enough to trigger positive results. Diphenhydramine, found in Benadryl, appears as opioids, methadone, or PCP on drug tests.

Officers' Interpretation Errors

Color interpretation remains wholly subjective, depending on the officer's color perception, training, and inclinations. Officers must distinguish between slate-gray and purple, blue and violet, fuchsia and purple. Las Vegas authorities found 33 percent of cocaine field tests between 2010 and 2013 were false positives. Florida data shows a 21 percent error rate.

Confirmation bias affects results. Officers test substances because they already believe them to be drugs. In close-call color distinctions, officers tend to see the color confirming their suspicions. In Hillsborough County, Florida, 15 false positives for methamphetamines occurred in seven months because officers confused which color indicated positive results.

Real LAPD Cases: Innocent People Arrested

Laundry Detergent Mistaken for Cocaine

Don Bolles experienced the consequences of presumptive field testing firsthand. In 2007, authorities arrested the musician for possession of GHB. The substance officers tested was soap. Laboratory experiments have demonstrated that at least two brands of field testing kits produce false positives when exposed to Mucinex, chocolate, aspirin, and oregano.

In 2003, a Pennsylvania college student spent three weeks in custody after officers mistook flour for cocaine. The presumptive positive led to immediate arrest and detention. Only after the state crime lab completed confirmatory testing did authorities release the student and drop all charges.

Fox 13 Tampa investigated field test validity after three separate arrests based on false positives. All three individuals faced criminal charges for months between arrest and confirmatory testing by the state crime lab. During this period, they operated under a "guilty until proven innocent" framework despite possessing no illegal substances.

Legal Substances Testing as Methamphetamine

Legal intranasal decongestants containing l-methamphetamine complicate interpretation of tests positive for amphetamines. Sudafed led to a student being banned from sports. A woman lost her job after Wellbutrin produced a false methamphetamine result.

Laundry detergent serves another purpose beyond cleaning. Drug users add detergents to urine samples as an adulterant to mask substance use. Soaps and detergents cause false negative results for amphetamine, barbiturate, cannabis and cocaine by changing the pH of urine samples. This chemical property creates confusion during field testing when detergents trigger presumptive positives.

Days to Weeks in Jail Awaiting Lab Results

False positives from field tests can cause innocent citizens to be detained in jail for weeks or months. The Quattrone Center estimates approximately 30,000 people are falsely implicated by presumptive field drug tests each year. These individuals face immediate consequences without confirmatory evidence.

During detention, people lose employment, housing, and face severe psychological trauma. The time between arrest and laboratory confirmation creates pressure to accept plea bargains rather than wait for exoneration. Prosecutors accept guilty pleas in 89 percent of cases without any confirmatory laboratory testing.

The collateral damage extends beyond the falsely arrested individuals. In fact, families suffer financial hardship, emotional distress, and lasting consequences from wrongful detentions based solely on $2 roadside tests that produce color changes officers interpret subjectively.

How False Tests Force Guilty Pleas

The Plea Bargaining Problem

Criminal courts resolve at least 90 percent of drug convictions through guilty pleas rather than trials. This statistic creates a critical vulnerability in the justice system. Field tests remain inadmissible as evidence at trial in nearly every jurisdiction. Prosecutors must present confirmatory laboratory evidence to secure convictions before juries. Whereas trial proceedings demand scientific verification, plea bargaining operates under different rules. Prosecutors in nine out of ten jurisdictions surveyed nationwide accepted guilty pleas based solely on presumptive positive results from field tests.

Every year, at least 100,000 people nationwide plead guilty to drug possession charges that rely on field test results as evidence. The Safariland Group, the largest manufacturer of these test kits, stated that field tests are specifically not intended to be used as a factor in the decision to prosecute or convict a suspect. The company's own guidance contradicts how the criminal system applies their products.

Lab Tests Skipped After Guilty Pleas

Crime labs rarely verify field test results after defendants enter guilty pleas. In fact, 67 percent of drug labs in a national sample reported they are not asked to review samples when cases are resolved by plea agreements. An additional 24 percent do not receive samples for testing when field test results are available. Even when labs do receive samples, 46 percent reported they do not conduct confirmatory tests if a guilty plea has already been filed.

This testing gap enabled systemic errors to persist undetected. The crime lab in Houston, Texas, decided to analyze all field test samples, even years after arrests. Testing revealed 251 cases between 2004 and 2015 that ended in guilty pleas where no controlled substance was present. Further investigation by the Harris County District Attorney's Office identified 212 cases where evidence identified by field tests was not a controlled substance. Authorities exonerated 119 of those convictions.

Prosecutors Accepting Field Test Results Alone

Surveys demonstrate widespread prosecutorial reliance on unverified field tests. Almost 90 percent of prosecutors reported that guilty pleas are permitted in their jurisdictions without verification by an accredited toxicology laboratory. ProPublica determined that 74 percent of people convicted of illegal drug possession did not possess any drugs at the time of arrest.

Courts in Las Vegas overturned five drug convictions after reporting detailed flaws in field tests. All defendants had pleaded guilty to drug charges while facing possible jail time. Drug evidence from those cases was destroyed without lab analysis.

The Pressure to Plead While Detained

Pretrial detention creates immense pressure to accept plea bargains. More than 400,000 people are detained pretrial daily, most because they cannot afford bail. People detained pretrial are more likely to plead guilty. Prosecutors make time-bound deals that are hard to turn down, or offer pleas with recommendations of time served, allowing immediate release from jail.

A criminal case is settled by plea bargain every two seconds during a typical workday in the United States. Nearly 93 percent of wrongfully convicted individuals received jail or prison sentences, including a substantial number legally entitled to probation. A majority were wrongfully convicted in their early 20s and 30s, burdened with criminal convictions that limited educational, job, and housing opportunities for years.

Disproportionate Impact on Communities of Color

Three Times Higher False Arrest Rates for Black Individuals

Black individuals face three times higher arrest rates from false presumptive positive field tests compared to white individuals. This disparity contributes to broader patterns of wrongful conviction. Innocent Black people are 19 times more likely to be wrongfully convicted of drug crimes than innocent white people. Among drug crime exonerations, 69 percent involve Black defendants while only 16 percent involve white defendants. Black people represent 13.6 percent of the U.S. population but account for 53 percent of exonerations.

The targeting begins before testing occurs. Black people comprise 12 percent of the U.S. population yet account for one in three drug arrests nationally. Studies demonstrate that Black and white Americans use illegal drugs at similar rates. Accordingly, the arrest disparities reflect enforcement patterns rather than actual drug use differences. Black individuals are disproportionately targeted for drug screens. Once a presumptive positive occurs, they face preferential reporting to authorities.

LAPD Testing Patterns in Different Neighborhoods

LAPD concentrates resources in historically hyper-policed communities through predictive policing programs. Operation LASER targets specific individuals within select neighborhoods based on criminal justice system history. Survey data reveals 76 percent of Los Angeles residents reported never being stopped by police, while two percent reported stops between 11 and 30 times weekly or more. This concentration creates what researchers describe as a racist feedback loop.
